bmw wouldnt return my deposit

basically i put down a deposit on a car almost a month ago. the deal didnt go through (not my fault) so i asked for my deposit back. a month later. still no check, i called the dealer like 3 times. first time he says it takes a week. ok. 2nd time he said oh he will check on it. 3rd time he said he cant believe i havent got it yet and he will check it the first thing tomorrow morning. and a week later.. still nothing. anyways. bottom line. can i dispute the charge on my amex since there was no transaction i.e. there was no deal. or do i need to go to the dealer and give him a good slapping?

i would walk into the dealer and not leave without a check.
then slap
then amex
then bmwna

Call a lawyer and send a hate letter. Yeah amex will help you.

No excuse for their "internal snafus".

Can they keep your deposit in NY? I know in Cali, it is illegal to keep a deposit or so I thought?

I was in a similar boat once but I got my deposit back in about 4 weeks.

well i went there in the afternoon and my sales guy said he has the paperwork right here but the manager is in a meeting and he will get it done as soon as the manager is done. told him to get it ready for wednesday and ill pick it up on wednesday or i will file it as a fradulant charge with amex then i went next door to the lamborghini dealership and test drove the gallaro
lucky i didnt even sign anything for the deposit. i put down the deposit over the phone so there is no proof i even authorized the deposit.

I wouldn't try to jerk them around as their lawyers are probably a far higher price tag then what the average Joe could get. They will get your refund to you.

I don't think there's any need for lawyers just yet. If they don't do right now, Amex should be able to put enough pressure. Good luck!
