I understand the point of the law and it seems the man was abusing the Cafe's free WIFI beyond an ok extent, I hardly think this was the intended point of the law, laughable none the less...

If you don't set up security on your wireless router, then it should be open game. What a bunch of BS.

I could see bringing charges against someone who hacked through security on a router, but this is just stupid.

Nothing was stolen. What the man was doing did not affect the Cafe in any way. He did not take anything from them.

It would be no different than if someone stands outside a club or bar and listens to the music they are playing over their sound system. If he did that, would you accuse him of stealing since he listened to their music without paying the cover charge to enter the club? You would probably instead say that if the music is loud, then anyone nearby has the right to listen. If the club wants, they can lower the music volume, or build more sound-proof walls.

Likewise, if they don't want anyone using their Wi-Fi, they can take the appropriate steps, i.e. secure their router.

I guess you decided not to read the information so let me specify the issue.

Michigan law bars access to anyone else's network without authorization, according to Michigan TV station WOOD. Since the cafe's WiFi network was reserved for customers, and Peterson never came into the cafe, he was essentially piggybacking off of the open network without authorization. That means he was stealing.

I understand. I would bet such a law would be found unconstitutional if challanged.

Theft of service is unconstitutional? I'm pretty sure that the cable tv industry could be used as a precedent.

Could be. It does presant a number of questions which at this point have no clear answer. I believe in Connecticut the law is different stating that a user must lock out other potential users via protection from within their own computers. IMHO i believe both sides have merit. I understand your annology. (music) But in the case of wifi one does have to make a effort to receive someone's Wifi signal with the use of equiptment for the expressed purpose of using it for their benifit without getting permission.

People who play concerts know that others people will hear the music and the artist understands that and does not expect or look for privacy in this regard. In fact it serves to some extent as advertisement for future concerts.
