Now more than ever we need to institute a penalty for bringing frivolous lawsuits where the loser pays the winners legal fees.

That would put an end to a majority of the litigation that is wasting court resources and costing some businesses and individuals their livelihood.

You can still bring a case against anyone...But you had better have what amounts to a good case.

There is already such a system. You can sue for legal fees and you will get them if you proove the case was "frivolous".

However, I think we should use the system they use in Europe where the loser pays the winner's legal fees regardless of whether the case is frivolous.

However, I doubt that will ever happen as the current system favors those with money as they can tie up the small guy in court and force him to settle since he can't afford the expense of a long trial. I've had this happen to my company before, and it sucks.
