Sexting teens - Child Pornography?

I think not. First of all, teens will be teens.
Second of all, even if they do prosecute the teens for sending the pics, you can't prosecute the teens for receiving them. They didn't buy them, order them, etc. Their girlfriends sent them nude pics.. Not exactly child pornography.

LASTLY and MOST IMPORTANTLY.. Nude pictures do not equal PORNOGRAPHY. PORNOGRAPHY connotes sexual acts, lude behavior. Nudity is not now nor has ever been considered PORNOGRAPHY, even in conservative America.

While most photographers do not practice such methods, it's not even illegal to shoot fashion type, nude shots or implied nudes with teens as long as parents consent. You don't see nude teens in movies anymore ala, The Blue Lagoon. But plenty of underage models do catwalks, photoshoots, etc.

It might not be in good taste, but it's not PORNOGRAPHY...

My point is, some overzealous prosecutor who is looking to making headlines is going to drag a couple of typical teenagers through the mud, in order to make a point and further ones career.

They should have quitely send these kids to a Psychiatrist or other and tried to get them to realize their behavior was stupid.

But labeling them child pornographers is just stupid, offensive and designed to generate headlines.

I agree that this case is a little overboard. As the one commentator stated, it's all the prosecutors/law enforcement had. It is a technical violation of the law but common sense and the circumstances need to be considered. What probably has gone on in the background is that some parents are irate and are pushing the issue. What is typically seen is that a girl sends a nude photo of herself to a boy via text or e-mail and the boy sends it on to others. That's where the distribution comes in and where parents and authorities usually find out about it. Parents are usually fueled by outrage that their daughter would do such a thing and she is now shamed. I would agree that you can't control what you receive but you can control whether you distribute it or not.

This is an ongoing problem that is very complicated for the exact reasons you point out. It's one of those crimes that is a crime but is usually not prosecuted. As a point of comparison, if you read California's statutory rape law (Penal Code section 261.5) it is illegal for minors to have sex and that would include each other. We know kids under 18 are having sex and almost all of them do so without being prosecuted.

Somehow kids need to get the message that doing stuff like this is not good. If anyone has the magic answer, please share.

How about CHASTITY BELTS ?? And stricter laws on dress codes that include ankles and wrists be covered at all times.

And I think it's a damn shame that ABSTINENCE isn't taught more thoroughly at school.

Cause really, it's not the hormones of a bunch of teenagers that are at fault here. It's the schools and their damn loose morals.

I think more religion would quite possible help the situation and any boy under the age of 18 that ever gets an erection should be immediately castrated.

The answer is no secret;

The best message children can get is the message from their Parents and adult counterparts.

Fact is the morality of parents and adults have gone down the tubes. The result? people honestly believe premarital sex is fine. Then when children want to practice that behavior they get bent out of shape.

If people expect children to behave differently then they need to practice what they preach.

But sex sells so there's not much chance in that is there?

lol...

If it wasn't for premarital sex my keyboard and mouse would have often needed replacing.

I lived with my wife for 6 years before we got married. I see nothing wrong with what we were doing.. And by doing, obviously I mean, holding hands, kissing on the cheek and reading each other poems..

I hear you. It's not realistic to play the abstinence game and hope for the best. I am quite familiar with high school campuses these days through work and while your imagination can fill in the blanks, I can tell you that the kids are as hormone driven as ever. Case in point: 15 year old going at it, full on sex, on the handball courts with people watching. Another case: Girl giving BF a BJ with an audience; girl doesn't miss a beat.

Everyone needs to be realistic and rational on this issue. See also below.

Amen to that brother but the truth is that too many parents don't deliver the message of morality. I'm not talking about premarital sex. I'm talking about plain old what is right, decent, and respectful. Common manners and basic right versus wrong aren't being taught by parents. With even the foundation missing it's no wonder so many young people do stupid things.
