Do Police in US have the right to make you roll your windows up?

Specifically in North Carolina, do the Cops have the right to tell you and make you roll your windows up say to check the tint. In russia they dont, so if your windows are tinted you can roll them down when you know youre getting stopped.

Can it be done in US as well?

ive tried to do a quick google search but nothing accurate comes up

In the us, they can't pull you over and then come up with shit to ticket you for. So if they didnt notice your tints, or you coming up on a check point, roll the windows down and take your chances

Each state in the US has specific law. In short it can be no tint or a specific % of tint for front door windows. In Europe, most countries don't allow front door window tint at all.

hahaha... you are comparing the apples and oranges

- the russia is modeling its newly found freedom after what it thinks the freedom in the US was - therefore the cops can't tell you or demand you to do something that is agaisnt the law and you can tell the cop "NO"...

- the US is modeling its system after the police state of Joseph Stalin, and the police IS the ultimate authority in the field and can make ANY demand - the moment you say "NO" to a cop, you are obstructing justice and instantly become a subject to an arrest, which is carried out with force, even when the force is not warranted.

the only way you can defend yourself in the court of law, post factum your encounter with a police officer, if you have a hard evidence, such as statement of witnesses or a video recording... which is, BTW, from what i had heard, in the state of MD it is illegal to video tape police activity, unless during commissioning of crime by the police... No so sure about the other states...

did you see that arrest in CA where they arrested a guy for "playing loud music" while he was videofilming their arrest of somebody, and then shot his dog dead... lucky dude he did not get shot... If they did not like loud music during the original arrest, so they could hear the scene better, they should have had the BIGGER area closed off...

I am part of law enforcement myself, but I personally scared of the cops more than i am scared of the crooks - how many other instances in your life where you HAVE to obey orders of a total stranger who is armed, and if you give him a lip, he will arrest you just for that... especially cops in small towns that have NOTHING else to do... cops in big cities are ok, as they have more real crimes on their hands, then the cops in small, sleepy places...

So true, just got shivers.
My uncle here (RUS) is also part of government and he was lawyer as well and he is the one who told me about not having to raise the windows up... recentley russia made a law no tint at all on front windows.

Very interesting question.

Nothing to do with tint laws, per se...but search laws.

I would submit that asking you to roll the windows up is the same as asking 'can I look in your trunk/glove box/interior... they are permitted to look into the car, anything else they need reasonable cause.

So the answer would be "Officer, I am going to decline your request to search my vehicle". See what happens. if it is followed by "I am not asking to search, I just want to see the windows", you might say "Well, I am going to decline"...maybe add "Oh, I work for the ACLU and we are in fact looking for a test case".


Now, arguably, the state MV code may require side windows (does it?) and he may have the right to establish your car does have the equipment required by the state MVC. Im too lazy to search your code there.

but even so, he would need a court order, and could hold you and the car until they get the court order.

So dont try it on a Friday, and not in the evening. Early in the day midweek and you'll be home for dinner.

NC tint stuff:

Although the DMV has some fine print that suggests '32% light transmission will pass Inspection'.

And, one can cop a Doc's scrip for exceptions, eg light sensitive eyes, etc., and get a darker tint...

Back at the Getting Pulled Over Ranch, my experience is that cops can pull one over for any moving, or equipment code violation, or suspicion of being impaired.

Being pulled over for speeding/other code violation, and then the cop wants to see your windows rolled up is a legal wiggle that a good lawyer may get one out of, jam-wise, after the fact, as in court. But, they do have the cop deal going, and in my 50+ years of driving experience, I have found it difficult/ineffective to play the armchair barrister card on the side of the road.

I've been in similar situtations - and have rolled up my windows to get tickted.

My buddy has balls of steel. I was with him one time, he got the same request...
He told the officer he would NOT roll up his windows, in fear of his life, that he would be taken as trying to get away, and that the office would draw his weapon on us. He offered the officer to roll up the windows himself. Long story short.....we walked away without a ticket....

Wow. You are not so seriously disillusioned and scared, are you?

This attitude is so unamerican that it makes me angry.

Maybe as a middle aged white guy it is easy to say, but we cannot just roll over and allow police to trample our civil rights
