Bumper Scatched Parking

So i drive my X into the city pretty much every day. Car gets parked on the street so I understand that I become subject to scratches from parking and dings. Normally whatever happens happens and I don't tend to make a big deal about it until I came back to my car about two weeks ago and saw the POS behind me was on top of my rear bumper. Ok maybe hes really old and didn't see. I get out and look and see that the POS is also on the guys bumper behind him now touching two cars at the same exact time. Now I'm furious. I move my car forward examine my bumper and see that he pretty much trashed it. Scratches are through the paint and will not come off. As I'm examing everything one of the servers comes out of the restaurant where I'm parked in front of and says "man that a$$hole was pushing both of your cars to get into this spot" gives me his name and number and says he will be a witness if I need him to. Now I left the guy a note telling him he trashed my rear bumper and he should do the right thing and pay for it and that I have witnesses etc. Guy never called me but I did see his car today for 3rd time since then and left him another note taped to his passenger side window saying to pay up for damages owed. Now I really don't want to file a police report as when I spoke to cops they said they would need to put it in as a hit and run since he is not present at the scene. I ran into the waiter at the restaurant yesterday and he said he saw the guy the day he was pulling out and told him I was furious and that he should call me. Guy told him he doesn't know what hes gonna do but good thing its a rental. Any recommendations on how to go about this? I really don't want to list an accident under the X since I know its only going to be a couple of hundred to fix it which will hurt the resale value more then its worth. Thanks
