I'm still considering both sides of the debate about her and the Ricci case seems to be a point that I'm not yet decided on. If in fact she really was unbiased as I think she is implying and decided her position on the legality then I can't object to her decision.

However, the argument used by others that factors empathy to determine fairness is at odds with how I think a judge should behave. Having said that, it's seems unrealistic to say that there is no personal bias in decision making.

Regardless, I don't believe the doctrine of empathy will keep her from being confirmed.

The quote in question from Sotomayor has emerged as a rallying call for conservative critics who fear she will offer opinions from the bench based less on the rule of law and more on her life experience, ethnicity and gender.

"I'm sure she would have restated it," Obama told NBC News, without indicating how he knew that.

Obama also defended his nominee, saying her message was on target even if her exact wording was not.

As a senator, Obama supported a failed attempt by Democrats to stall President George W. Bush's nomination of Samuel Alito to the high court.

That's like saying, "if your aunt had balls, she'd be your uncle". Of course a white man is not going to have the same life experiences as a latino woman.

The courts DO have to try to interpet the (really badly written) laws of the land. Too often (or never at all) there is no explaination of what wrong was to righted by this law. And once written, it is often twisted into something never intended. But it is NOT the courts role to MAKE law. (one of her Freudian slips) Using the courts to force change that can't be passed in Congress or the states, is a favorite tactics of the far left. The Supreme Court should not be the venue for such a judge.
