Sotomayor, Supreme Court...issues.....

This should be interesting...

U.S. Supreme Court overturns ruling backed by high court nominee Sotomayor in white firefighters' discrimination case.

Quote:

The Supreme Court has ruled that white firefighters in New Haven, Conn., were unfairly denied promotions because of their race, reversing a decision that high court nominee Sonia Sotomayor endorsed as an appeals court judge.

New Haven was wrong to scrap a promotion exam because no African-Americans and only two Hispanic firefighters were likely to be made lieutenants or captains based on the results, the court said Monday in a 5-4 decision. The city said that it had acted to avoid a lawsuit from minorities.
FULLY agree.

Who was the swing vote? 5-4 is close.

Here is the full text of the decision w/ dissents.

I would hope the split is always close, if it isn't there is a HUGE problem when reviewing another courts ruling IMO.

In the original: In June 2008, Sotomayor was part of a 7-6 majority that denied a rehearing of the case by the full court.

Lets get this straight, they scored higher on the test but didn't deserve promotion?? :dunno:

Quote:

The court's more liberal members joined Justice Ruth Bader Ginsburg's dissent which she read from the bench. "The white firefighters who scored high on New Haven's promotional exams understandably attract the court's sympathy," she said. "But they had no vested right to promotion."

Its about time, discrimination should work in both directions.
We had the same problem here with police were they said the tests are too hard
for African Americans. So the city actual paid African Americans to avoid any major
law suits.

This is crazy either you got what it takes or you don't.
This is a discrimination towards educated people, period!

I can not believe Ginsburg's statement - just what was the purpose of taking the test?

I vote to remove the race checkbox from applications, examinations, etc. Let it be 100% purely by qualifications. But logic like that is far from reality.
