The same on mine, leak just where no 3 is on the draving. Have looked at it from the hood and from under the car, seems like a thite fix. Did you need to remove a lot to acses the end on the gear...

I am no expert on this, but that worked for me. The e39 run fine for over 3 years after the same symptoms you have, i sold it one month ago and bought an x5.

There is no level check far as i know, BMW calls it liftimeoil. The price in Norway is about 800 dollars to replace oil and a small filter innside.
