UK speeding Ticket
 

Yesterday (29th) i got a letter from the Police. Apparently my X5 was caught on a speed camera on the (18th)

They are asking who the driver was. Well it wasnt me, it was my wife! I think! Cant remember what i was doing yesterday let alone a week ago.

Surely am not at any legal obligation to divuldge this infomation to them. Surely the burden of proof should be for them to proove i am guilty of the offence or who the driver was.

I was at work, and work would confirm that at the time of the speeding i was in the office.

Should i be the one that incriminates my wife? surely not! I dont even know she is guilty!

A work colleague had a similar problem (in the UK) - except he had a better excuse - he genuinely couldn't remember who was driving the car, himself or his wife, and apparently the police had a real problem with that. I think that, technically, if you know that your wife was driving, then you are under an obligation (as the owner) to say who you allowed to use your vehicle (or something like that).

This happened to me. I sold a vehicle to a friend who then got caught in a speed camera. First I knew about it, got a letter in post but as I didn`t own the vehicle I simply wrote the new owners details on the NIP and posted it. About 2 weeks later he got the NIP but claimed he didn`t know who was driving, the Casulaty reduction people in the UK are so under staffed and busy that I dont think they have time to chase up cases like this and just dropped it. He hasnt heard anything since and it`s been months now..

I guess that if you were at work you would not know who was actually driving the car - you would only suppose that it was your wife....but can you prove it :p (and would you want to :rofl: )

Same happened to me and i told them my cousin from the states must have been driving. I gave them his name and address in the states and never heard from them again.

He never got a letter so case closed.

That's interesting. In the USA, the owner of the vehicle would be ultimately responsible, so if you refused to divulge the driver, you would get the ticket.

On that particular day i dont really know who was driving. all i know was the car was either parked at home or at my work. I was definetily in the office on that day! If was at home, wife could have been driving it or even my father! Its one of them.. but who should i blame?

Question is - should the police not proove who was driving it.. rather than me? I can easily proove it wasnt me cos i was it work at the time of alleged offence!

I dont think they have to prove it, the owner of the vehicle is responsible and should know who was driving. I would be tempted to delay them by putting your wifes name on the form, then when she gets it, put your fathers name on it... I`m sure they`ll drop it eventually.

What does the law require?
Find out. Then work within the confines of the law and beat the case. In most cases it's easier than you think. But if someone was driving your vehicle and violated the law they should step up and handle it. That would be the right thing to do.
