By the way, all '07 and '08 3.0 models have an inherent design flaw that causes the noise. It's been well documented in e90post.com. It's not your particular vehicle.

They sold you a CPO car with defects at the time of the sale. It isn't like this stuff jsut started. Something smells wrong.

I'd return the car, then sue them for the lojack and extended warranty. Won't take long for a judge to side with you, IMO.

Edit: I actually think they are bluffing. Tell them they can have it back, see what they say.

I plan on it... I want to return this one, get a refund and buy a new one. I'll have to sell my Rubicon and that makes me sad but I don't really need 2 SUVs.

Update: Steven's Creek has agreed to refund my money. I said "100% including the service contract & lojack?" Jason said he'll have to look into that and get back to me. Then hung up.

Weird... I posted in another thread where "jackie" had questions on buying a used 2010...then see this thread and find out that user "lemon" is now user 'jackie'. Hmm

My advice will be to get your refund in writing ASAP. Do not be surpirsed if the sales manager says "I'm sorry, the salesman exceeded his authority...we cannot take the car back".

You are dealing with spoken words and it is awfully murky... like I said, try and get something in writing, even just the car- and THEN press them for the rest of it.

Yeah, I asked the admin to change my name from lemon to jackie :)

The dealership called me back today and offered a refund. I'm going there monday to sign it back over to the dealer and get my money back... I started looking at other "deals" that might be out there but I don't like what's out there. I'm starting to think I need to order a new one, like I've done with all my cars in the past.
