40 days and they are talking Buy back
 
So it is day 40 since I have seen my X5 and my SA just called and said that BMW cannot fix the car. They have brought multiple Field techs in to fix the issues and nobody including techs from Germany can fix my issues. So they are talking about buying back the car and getting me an new one. Who has had BMW purchase a car back and what should I expect. I only had the car for 3 1/2 months before it entered the shop and am wondering how badly are they going to depreciate the car. I spec'd and ordered the car which ended up just north of 80k and I am worried they are going to hit me for 5k in depreciation. Any thoughts

Lemon Law....you shouldn't be hit with anything.

Usually they will give you your full money back on a situation like that, a lot of times even after a year, so you should just be able to start over and order what you want being out nothing but the frustrations!

Price- that dealership is a good friend and does not deal in new cars. I was asking if anyone has had a buy back from a BMW dealer on a new car.

The comfort access is all messed up and BMW is finding ghost keys registered in the system which cannot be found in BMW's key list or removed from the computer. They have replaced a bunch of modules and keys and still cannot get the car programed properly.

From several buy back threads on the site, found via Search Tab, I would think you are clean, including some $comp/payment coverage/lease coverage, etc.

With a buy back, they will replace the car to the same specs, or you may add other options (at your cost). They call it a trade assist. Your cost should be ZERO.

On my 07 that had motor issues, they just ordered me a new 08 and it didnt cost me a dime.

Should not cost you ONE cent, unless you replace with more expensive options, or a more expensive car. When my 330cic was replaced, it cost me nothing. New paperwork, some signatures, about an hour...and I had a new car. I chose a different colour combo than I had, but the options and packages were identical. So easy, and BMW was gracious and very helpful!

BMW should just give you MSRP credit to any other vehicle's MSRP. When my parents did it, they stepped into a X6 after a X5 buyback.

Post the VIN. So the new buyer might be warned by google.

Most lemon laws have a mileage proration...So that would be the 'floor'... you can better the deal by saying "I won't make you lemon it, if you can pay me X".

As I recall, in Cali, it is current miles/120,000 times the original price paid.

Duh. Found it. Rather amazing, isn't it? Can't program. Interestingly mine has had three bouts of 'programming', and each has been a challenge for the tech.

I guess they'll roll it back to the plant, have a new electrical system (ie every single module, computer, etc) installed and begin anew.

BMW Buy Back, California Style
 
BMW authorized by back of our X5 35d last August. They requested a copy of our registration. Several days later, an e-mail arrived with a proposed settlement, which turned out to be a refund of everything we paid into the car (down, tax, warrenties). Charged $0.52 a mile for use.A third party called to make arrangements, met at dealer, signed papers, handed us a check.

Our thoughts were that Cali law mandates to pay off the owner to let them decide whether or not to stay with manufacturer or go elsewhere.

For what it is worth, the process worked well for us, just took awhile since our X5 was not in the shop for 40 days, but almost.

We had a 2004 745i that was a Lemon. We hired a good Lemon Law Attorney and were refunded all 19 Months Lease payments and the total drive off we paid.
So basically, we drove the car for 19 months for free. It had a defective Fuel gauge. They could not fix it after 5 tries.

Heck, I wish it would happen again. It was not so bad driving it using the odometer as a fuel guide.
