Incorrect mileage on title - DMV won't issue new title
I recently purchased a CPO 2009 X5 with 23,790 miles and was waiting for my title. Unfortunately I received a letter from the DMV saying that the mileage on the previous title was 83,333.
The dealership is saying that a typo must have happened somewhere. The DMV is saying that unless they receive a letter from the original ownership state's DMV saying the mileage should be 23,790 miles, they can only issue a title showing 83,333 miles or 23,790 "NOT ACTUAL". Has anyone ever had a problem like this? Typo that can be fixed or a case of dealer fraud where I should speak to a lawyer? |
It can be fixed but it's a PITA. It's the dealer's problem and I would make sure they know it. Call them and demand they make it right.

See this all the time at dealer auctions. What a pain in the ass.... Definitely have dealer deal with it. Was it a BMW dealer?

this seriously impacts the resale value, make the dealer pay to make up for this or buy it back from you.

What did Carfax show? Previous titling would be there, along with the respective mileage record.

Carfax doesn't always represent the true mileage. Since the mileage is under 50K, just go to a BMW dealership and have them read the key. From there it can show you if there has been any service after the 23K miles. If so, you know you have a problem with mileage.

Do not let the dealer try and wiggle out from fixing this...THEY made the $$$ by telling you "oh, we are a professional car dealer and we will make sure all that complicated paperwork is properly filed"...make them earn their money.
Every time that sound like they are pushing back on you, respond forcefully. They must make it right- OR take the car back for a full refund plus tax plus fees. They owe you a clean title. I bet 8,333 was made into 82,333. Report back. |

By "Previous Title" I think the OP is referring to the title that the dealership was holding, not the previous owner.
I would wager that the OP was charged the typical $100-$200 "Doc filing fee" when they bought the car. That's supposed to cover the dealer doing the paper work and submitting it to the DMV. If that's the case the OP never even saw the error because the dealer sent it directly to the DMV. The OP bought a vehicle with 23,790 miles, a valid title is assumed. It's the dealers responsibility to make this right. |
