Incorrect mileage on title - DMV won't issue new title

I recently purchased a CPO 2009 X5 with 23,790 miles and was waiting for my title. Unfortunately I received a letter from the DMV saying that the mileage on the previous title was 83,333.

The dealership is saying that a typo must have happened somewhere. The DMV is saying that unless they receive a letter from the original ownership state's DMV saying the mileage should be 23,790 miles, they can only issue a title showing 83,333 miles or 23,790 "NOT ACTUAL".

Has anyone ever had a problem like this?
Typo that can be fixed or a case of dealer fraud where I should speak to a lawyer?
