Congrats. Looks like a very nice, clean example. Better than mine and I paid more with more mileage. Though mine is a 4.8is... the 4.6is is more rare so I think you got the better deal.

Not a great day
Before I drive over with the money I asked seller about title.
He bought it about 5 weeks ago. He didn't get the title changed over to his name. I don't want to try to convince the DMV that he resold the car to me WITHOUT paying his sales tax. Tax man always gets their money. I had to walk away with out the X5. Am I understanding the transfer of ownership of title correctly?

If the owner that sold the X5 to the party you are buying the X5 from signed the title over and your seller never signed the title as the purchaser, as far as anyone knows the X5 was never sold to him. Sales tax is paid at the time title transfer. Sounds like your party has never signed the title or licensed the X5 in his name, that his only intention was to flip it for a profit without paying sales tax. Ask the DMV what to do if you still want it.
