Depending on the state, county, city the cost amount to leave Small-Claims court AKA do it yourself court can be quite low and may possible to file a charge of "Theft by Deception" with the local DA. You paid for object 1 that would perform task 1,2,3 but instead they gave you similar object 1a that does only a minor percentage of what you paid the full price for.
I would try to get as much in writing from them as possible even if you aren't trying to make a legal case against them as they may try to bring a case against you for leaving an honest review and unless it's "Giuseppe Motors llc." they probably will fix the key issue instead of the bad publicity of yelp or whatever. If you do buy one, buy a known-good one, or buy it from somebody with good ratings who will help you if you run into problems. oh, and by the way, parts from a dealer should be warrantied for 2 years, so if you DO want to fight the dealer (might not be worth it), you have time. They know it is #5 because 1,2,3 and 4 all already came from there, they know what they are, they know about 6,7,8,9,10 and that they have not been released yet, etc. Separately from your situation, I believe there is an option for them to access your car and turn off some previously issued codes, but that would not be needed when just buying a new key. So basically, to me, this does make sense, although the stuff you were originally told at the dealership is clearly wrong.
