Yes, still under warranty at the time (CPO) with the maintenance plan as well. I complained adamantly because my 2 yr old son is usually in the X5 with my wife when she is driving -- they said it would be no problem and would be happy to reset the software for me because, as they said, this is the cause of the problem...

That being said, it still occurs every now and then -- so the software reset doesnt seem to be the fix for this. Any other suggestions on how to correct this would be greatly appreciated. Last thing I need is my transmission to fail or for an accident because the X5 is jumping forward.
