your concern is most likely caused by wornout intermediate levers and the eccentric shaft. common problem on 2004-2006 MY 4.4 x5. most occurances occur at after 50K miles.

Thanks killcrap. I'm only at about 37,500 miles. Could it still be the case?

Just saw this on another forum about the N62 4.4 engine service bulletin for intermediate levers: Car has been in service for two weeks now!!! - 5 Series Forums

Sounds like my issue because I didn't see any oil leaks anywhere. Killcrap, thanks for pointing me towards the lever issue. I'm out of warranty, but have an aftermarket one. Since this is a legit BMW SIB, would this be covered by BMW or through my aftermarket warranty? Obviously, I can't do anything until i get the codes read, but trying to get myself prepared.

you are out of warranty, the bullitin only applies to vehicles under the factory warranty, CPO/ESC warranty. if it were a recall, then it would be covered. wouldnt bet on any aftermarket warranty to cover it. if you have a good relationship with the BMW dealership, they would cover it 100% parts and labor.

You didn't need to search another forum. Just search this one; this issue has been discussed at length in the past.

These pictures are worthless to anybody that owns an X5 3.0. Even though we share the same engine as the 528i or 530 the procedure is very different from what the pictures show. Do not use them as a guide for removing your oil separator. However that being said, it is still possible to remove the oil separator and tubes with out removing the intake.

Just wanted to give anyone that is planning on doing it them selfs a heads up.

I am getting worried about the OS. I think I am just going to replace it before I have any trouble. I am wondering if I need to order new Intake Manifold Gaskets as well?

How do you know if this is needed- if all need replacing why is there no recall. I am at 44K and she runs like new- should I replace?

Recalls cost money, but so does engineering better parts. That's no longer the BMW way.
