i know i'm talking to myself a bit but figured i would post my findings. so the trans felt better, no lights, and worked well for a few miles, then it slipped when going into second. i also found that it seemed to shift on its own in manual. to me this point to the car not knowing how fast it is going. i did keep tabs on the speed but have before and didn't notice anything. (i think this is separate from anything i'm working with)
there are two pulse generators in my trans, item #6 on RealOEM.com BMW E53 X5 4.4i A5S440Z MOUNTING PARTS CONTROL UNIT seems like a lot of work if i'm not 100% sure this is the speed sensor error p0721 is talking about.

Hey man, I thought about you when I happened across this post. It rang a bell because you mentioned your battery had a low charge when you had it checked. Might be the alternator. See post #65.

my truck is out at AAMCO in East Hartford, they are going to rebuild the trans / torque converter and it will have a 36K Miles / 36 Month Warranty. its not going to be cheap but i knew that, it will beat dealer prices though. (they are going to open it up tomorrow and call me with a firm price) i've talked to many people about rebuilding my trans in the area and AAMCO was definitely lower in price than others and more willing to do the work. i guess having a 36K mile warranty is good enough peace of mind.
i looked into a used trans and they run anywhere from 1800-3500 and have 90K miles on them... (kind of a pointless purchase if you ask me.) (but i have seen so-called rebuilt ones, on ebay and other sites in the 1800-2500 range, but who knows with that. would be expensive mailing transmissions around.)i love my X and can't really see myself driving anything else. (out of vehicles i can afford) looks like i'm gonna keep her for a bit longer now... i just hope nothing else major gives way. while they are in there i asked to have the rear main seal changed and to take a look at the oil pan gasket. anything else in there that would be good to fix? i'm sure they know and will take care of me...
