You were not ripped off. Your previous owner may have installed or paid another shop to replace the fan clutch. The previous owner may have purchased a used fan clutch with fan on the internet, local sale, or ebay, junk yark, whatever.. Or the shop he used installed the wrong fan clutch/fan, or had a E38 fan clutch on the shelf, and couldnt sell it, so he used in on the car. I dont understand how this would even been remotely considered as being ripped off, as you did not pay them, or the owner to do this, because you purchased the vehicle as-is most likely. What you need to do is replace the fan blade and fan clutch because you had the incorrect ones installed.

that is if thats the case but i dont know maybe he replaced the motor and didnt tell me because he did tell me it was an original motor.. so i would considr that being ripped off.. but i dont know unless i get the car fax and see but what you think can be right to i wont know

you bought it and owned it for 2years and you never noticed it was an inline 6 instead of a V8
the old man pulling a fast one on you reminds me of the scene in dumb and dumber where the old lady takes all of Lloyd's stuff from him

He has a V8, not the in line 6. Since BMW is very good at putting Vehicle Identification label all over the car, I would think that you could get the serial number off the engine and ask BMW what car was the engine installed in.
