Dealer replaces CV boot, three months later axle fails

The dealer (Hendrick) replaced the LF CV boot on 12/20/13 at Inspection II. Three months later, the complete axle fails. Do I have a case to ask for reimbursement or credit for the CV boot? Obviously I'm not trying to seek reimbursement for the axle.

And, I may be making myself into an idiot, but "FRONT DRIVERS AXLE SEPARATED FROM OUTER HUB ASSEMBLY AND DAMAGED THREADS ON AXLE" is the CV axle, correct?

It's been a LONG while since I visited a dealership for repairs... but try to find these text in your receipts:

"will warranty the new and re-manufactured parts and accessories it sells against defects in materials or workmanship for a period of 24 months commencing on the date of sale or installation."

Right, but the CV axle IS the "drive axle" - right?

Because I am going to SLAUGHTER Hendrick BMW if it is.. They refused to provide BMW of Cola with invoices pertaining to my valve cover gasket replacement (so that it would've been covered under warranty), and instead called it a "gasket sealing the cylinder head cover."

When the CV cover is ripped the CV joint can be damaged by water, etc, and subsequently fail.

If they damaged the CV joint when they did the repair, or left something loose, or the new boot caused a failure, you would have a case. If they simply replaced the boot and the joint was already damaged, and then failed due to that existing damage, then you have little recourse. In that case the repair was not a good investment (and perhaps they should have checked the condition of the CV joint) but I don't see what you would claim back to them on.

It depends on the nature of the subsequent failure, not on the fact that the same part is involved.

yeah, if you waited to take the car to them until it was making a clicking noise in turns then that cv joint was already on its last leg to begin with. surprised a dealer would actually change just the boot on one if it was at that point...unless you screamed at them that was all you wanted done...

you can get a complete new axle with lifetime warranty from autozone for $75 and just have any old shop toss it in. just saying.

if you're decent with tools, you can rent the stuff you need from autozone and do it yourself in about 2 hours. took me an hour on my 01 x5's left axle two weeks ago.
