Tale Of Two Indys.
A Tale Of Two Indys. It was the best of times, it was the worst of times…. Having taken delivery of our “new to us” F15 we placed the E70 in the hands of an indy for OFHG, OCG and replacement VC. He received it Nov 9. It took 3 days to do the work and we picked it up Nov 11. After driving the 40 – 45 miles home I noticed a TICK coming from the valve train that was not there when we dropped it off. So we dashed back to return the car before the indy closed. We have not seen the car since. The VC has been removed three times in all. The oil pan was removed, the bores were scoped, both inlet & exhaust manifolds have been removed. We have now reached week 5 and I lodged a complaint with BBB. The car was hurriedly reassembled and transferred to another indy two blocks or so away by the owner of the first. I say hurriedly because they cross threaded the fuel rail unions. Second indy found pool of fuel lying in the area of the head. It took him a week to open the hood and find this. He replaced the rail after another week and, despite being told by owner one to order parts and complete a total head rebuild, sat on the vehicle for another week doing nothing. This came to light yesterday when I called owner one to find out what was happening. I was not party to the conversation between owner one and owner two but, I was assured we should get the vehicle next week. Yea, right! So here we sit between a rock and a hard place wondering what it would be like to be a two car family again and wondering just what next step to take. “It is a far, far better thing that I do, than I have ever done; it is a far, far better rest that I go to than I have ever known.”

If you weren’t told about the transfer from shop one to shop two and did not authorize it - I’d be suing someone for 5 weeks of rental in the F15 I’d have rented and be driving now.
I would also be sure to let those owners know that I am a member of a shared BMW forum and if my car doesn’t become more of a priority I may be forced to share their business names with half the world. Now I know I’m not there and I would always rather have something done right vs fast, but this sounds like a royal screw job. Brother I wish you the best of luck!! Talked with a lawyer I know and he would want $10K to proceed so that is the last avenue of recourse. I'd rather stick $10K into another car along with the one in the shop/s as trade.
That way we get the benefit and not pay for a nice vacation for somebody else. This comes after spending 6 months looking for the F15 after selling the E53. We were nursing the E70 along with leaking VCG. I'm just glad we waited until we had another car as it would have bee a real pain had it have happened when it was our only means of transport. Rentals? We gave up calling the local rental agent. Seems the only bought an answer machine and never actually hired any CS agents.

Yea... i had a similar experience and totally understand where you’re at and what you’re saying. I worked sales for a company that “forgot to send me my last three commission checks” after I left. They continued to “forget” so I as well contacted an attorney who, unfortunately, told me that it would cost me twice what they owed me to fight them...
Sucks - but I totally get where you’re at. Me, I took my truck, a grill and two dozen of my family members and walked up and down the sidewalk, which is public space, in front of their offices for three days - funny how quickly they found those checks they owed me. I've threatened to do just what you did and the threat was enough. I'm playing it very cool and just trying to get car back fully restored to running order. We are not letting it ruin our Christmas and having said that: Merry Christmas Everyone.

Wait, aren’t these “tale of” stories a study in contrasts?? which one in the bad Indy???
It’s funny, something you hear a lot of is “lawyer up”. It’s the rare wise man that recognizes the underlying truth of this path. IMO you need to understand where you can find YOUR leverage. Is it reputation? Licensing with the state? BBB? Do they have other liability/exposure when it comes to moving the car to another lactation/business? Dunno, and dunno what state you are in. California isn’t Alabama when it comes to consumer protections.... What’s your states limit on small claims? Could you file two actions against them? One to each. Are you personally able to represent yourself (its a pretty low bar, but some people cannot do it.) Finally, once the dust settles and it is clear he has ruined the motor, a ‘come to Jesus’ meeting with one or both of them....tick through the state auto repair laws and rules they have violated...how the evidence you have is undeniable.... with a “look, I really dont care about spending 10,20k on the atty- its the principle of it. You guys will be facing a real mess here, but it’s your own doing. You can an opportunity to walk away for $15k.” Then settle for 10. Anyway. MERRY CHRISTMAS. It’s just the car. Pretty low on the list of life’s challenges |

Sorry to hear you got roast on the repair.
Thats why I do all of my own work. Im paranoid and dont trust anyone with my vehicles. Even if its a job that requires a lift which I dont have I stand there the entire time Killing a motor for a valve cover replacement job is pretty cut and dry I would think legal wise. But you never know.
