UPDATE - FRIDAY DEC. 7, 2007

So today finally they give me my car back, and the engine sputter and seat problem seem to be fixed.

So I'm driving my X5 home finally, and the windshield washer fluid light comes on, saying that's it's low. Therefore I turn around and have the SA top it off. At this point I'm thinking why the heck it even needs to be topped off when it's new.

Anyhow, I drive away and about two miles down the road, the same light comes on again.

I go back and this time a tech takes a look at it, and half an hour later, they come back saying that it had a bad sensor that had to be replaced, which they did on the spot.

Again, as you can imagine I'm irate because this is a two day old car, with 30+ miles... why is all this crap going wrong with it? So fine, they replace the sensor and I'm on my way.... all is well until I get home.

SAME FREAKIN' LIGHT AGAIN!!

Now, I'm furious... I call the dealer but they've closed early for a Christmas party. So now what?

Does this constitute a lemon? Or not really because they are fixable things? Please, help me out here as you've always done... I'd really appreciate it. Thank you!

Sounds like a streak of bad luck but would not give up just yet.

When I got my brandnew Audi Allroad 4 years ago the tiptronic gearbox had to be replaced after.......... 1 day (!).
After having to wait for my new car for 3 weeks of repairs I took it out for a spin when all the warning lights started flashing.....got towed again and turns out the boardcomputer had to be replaced.

Obviously it kinda took the fun out getting a new car but I have to say after the initial headaches I've not had a single problem for the subsequent 4 years.

Seems to me that the QA test on your car was not done or badly done.

My honest advice to you is, first and foremost, keep a calm head. Like you, mine had it's first service visit scheduled when I went for delivery.

Document everything, and almost as important, you need to ensure that they are entering this into their system. You should get a printed page after every problem that clearly states the issues.

You are nowhere close to the land of lemon yet, but if things continue in this manner, having all of this documented will go a long way to helping your case.

In the end, it is probably just a bad sensor or connection

Thanks KEF and Yosemite Sam...

Regarding the washer fluid indicator, they did replace the sensor then and there. So, I'm surprised that this is still coming on, but as you pointed out... I'll attempt to be patient and hope everything works out, thanks!

The most important thing is to document everything and ensure it is in their system as well.

If this continues 4-6 weeks from now, you don't want them to be able to say "there's no record of this in our system dating back to delivery".

I trust it will all work out in the end, but I do know, first hand, how frustrating it can be.

you'd expect a little more from a company that sells 70k cars. even a small player like Honda knows how to treat customers. when you buy 2 cars that cost 120k together you should expect a bit more than a cup and some plastic mats. if people would complain harder I bet BMW would have to spend more time in testing the cars.
hope everything works well for you.

at one point it crossed my mind to buy an e70 but after dealing with bmwna I am rethinking my purchase

I'm completely disappointed with the quality control pre-delivery. Clearly they are not catering to 'car people' as much with the X5. I'm hoping that all of the quality control issues are not related to the vehicle being built in the US.

As 'car people' we all tend to look at our options. On the Audi Q7 forums, there is no chatter about these types of issues. It's all color, interior, pictures, you know, the fluff of ownership. I wish that SUV handled like the X5. I wish either of them offered something like a 3.5L twin turbo diesel.

Audi will have a diesel in the Q7 for 09. Not sure about twin turbo or not...
