Also, I was told that mine (Yeah Me!) was the first that BMWNA had heard about having this issue. So, I may just be the tip of the iceberg here if others are having a similar plight.

Got mine back after 4 hours...didnt even have enough time to dent the loaner. The tech adjusted the top and bottom latches - hopefully fixed - knock wood.

They did that to mine the first time too. Lasted about 4-5 days before starting again. Hopefully you will get better results, but don't be surprised if it starts again.

Bounced again, back to the dealer. Perhaps my dealer and your dealer can talk since it appears to be a 'new' problem.

My dealer is The BMW Store. My SA is Eric. You can call and talk to him Monday and he may just give your dealer a call and let them know what we are doing.

Well, just got it back from my dealer.

The controller unit was replaced. However, after waiting almost two weeks for the part, it wasn't the problem. After replacing it, the problem persisted. They took the rear hatch apart and apparently a chaffed wire was to blame. Fixed the damn wire, and voila, no more possessed auto tailgate.

So, now I have it back. It is working just fine. No new problems.

mine did this yesterday afternoon, strangely enough

I fiddled with it for a bit and after a 5 or so tries it closed and stayed closed. came inside, went about my business then saw this thread

car was at the dealers yesterday and they cleaned it for me, maybe the bottom tailgate didn't close properly. I made sure it was shut this morning and so far it's ok
