Looking to buy a 2008 X5 3.0si

Hey guys,
I'm new to the forum and I've been searching for a 2008 X5 with everything I want in it. I came across this search

It has everything I want in it 'cept I don't need the third row but I'll live with it b/c it's the exact color combo I've been waiting for.

I live in Texas but the X5 is in New Jersey. Has anyone bought a car out of state? Who's taxes will I end up paying? TX or NJ?

Also, the guy offered it to me for 49K, but that doesn't include $650 for shipping. Is this a good deal or should I ask for more?

Based solely on what I can get from the photos, a similarly configured '09 xdrive30i is around $60k MSRP.

Yeah, I'd like to buy a new one, but my max is $50K b/c I'll be paying for the X5 in cash, no financing.

I wouldn't mind spending a few more to get new but how much are people getting new X5's under MSRP?

Also, is the '09 model a little more reliable than the '08's?

For the most part, I don't see any glaring differencese between an 08 X5 3.0si and the new 09 X5 xdrive 30i. So, I assume that any reliability ratings that you're able to find online or on magazines for the 3.0si should be applicable to the xdrive 30i.
