The prices have not been published yet for the "regular" Canadian model...so the deal has various clauses in it (% off's and walk-away's). So neither of us know the true final price yet

When I was still considering the Mercedes ML320 BlueTec, the salesman told me that any ML320 BlueTec I ordered would be a 2010 BUT they couldn't tell me the price because it hadn't been announced yet - DUH. I told him the BMW dealer could still order an 2009 X5 35d and COULD actually tell me the price. So I told the MB salesman to take a hike.

IMO This year end BTO pricing practice by both BMW and MB is short sighted. They should simply set the price of any vehicle you order at the currently existing published price at the time of the order unless you specifically request next year's model. If they can't build this year's model, that is their problem, not yours. If they don't want to sell you next year's model at this year's price, they could always publish next year's price NOW.
