I found this part:

16137193479

Here:

RealOEM.com * BMW E70 X5 3.0si Activated Charcoal Filter/FUEL VENTILAT

Cost: $100

BMW Fuel Vapor Detection Pump "Leak Diagnostic Pump" 16137193479 - RM European Auto Parts

So yes, being scammed IMO...common or not.

The pump creates the pressure that the system monitors to determine if there are leaks in the evaporative emisison control system.

Why isn't it under warranty? Emissions systems are warranted for longer than the base vehicle warranty.

Edit: I checked the list of specified emission control devices (which have an 8 year warranty) and this pump isn't on that list. Not sure if the list was different in 2007 or not. Interesting that the emissions system is only guaranteed to perform for 24 months, not 48 months, and with this pump failing it wouldn't perform. Still worth asking your dealer.

8 years 130,000 km for specific control devices in the emissions system.

The pump could conceivably cause that problem, but diagnosing over the internet is no substitute for actually reading the codes and doing a proper diagnosis.
