x5 acceleration issues

After having my 2008 CPO x5 4.8 for 2 days, the car already has a malfunction - where it states the car only has 1/2 the power and the awd/ssc malfuntion

My wife was driving and said all lights went on (error warning signs) and car wouldn't go faster than 20-30 mph

obvioulsly BMW is closed today (but we hasd to get car towed there)... but i called my salesman whom i go the car from in California, he said it may be the battery?? car was on a truck for 2 weeks from Cali - NJ being delivered to my house -- does this sound correct a new battery can fix the car?

is this common.. thank go no kids yet or i would be really really pissed having this occur after 2 days of ownership -- any advice would be appreciated
