e70 NAV Screen blacking out - question

The NAV screen in my 2007 X5 4.8 has done the blackout thing a few times in the past (mostly when its cold, as others have noted). About a month ago, it was in for some other service, I asked them to look at it.. dealer said there was no error codes in the system, and they could not reproduce the problem.

I was charged about $100-120 for a software update, and this past weekend, about 3 weeks after the software update, the screen went black and would not turn back on. It was at the dealer yesterday, and I'm told it needs a new system.

The X5 has approx 58,000 miles. I've had it about 1 year. The dealer said they would speak with BMW about getting 'assistance' for the approx $3k cost for part and labor.

As much as I love this car - in the year I've had it, I've had the pleasure of driving multiple new BMW loaners. The car has a CPO warranty, and factory maint, which should help keep maint costs down, but having to spend 3k on a NAV screen before 60k miles is unacceptable. Can anyone offer suggestions for how to approach this with the dealer should BMW choose not to help??
