Brand New 2012 X5 B pillow welding issue?

Hey guys,

quick question since I have never experienced something like this

I have purchased 2012 X5 35D about 5 weeks ago,

and since day one it made strange noise from B-pillow, and it wasn't loud enough to bother me too much, however, as it gets older it start to make louder and louder

so on my 3rd week, I took my X to the dealer service center even before I have received my license plate.

and they had it for 2 weeks now by replacing seat belt to everything possibly they can,

and today, they called me said on the B-pillow the weld was not properly seated from the factory and told me they can fix it by taking it to the body shot and get it welded.

and I told them HELL NO!!! it is a brand new car that I have leased about a month ago, and it needs to be welded?

so I told them to buy it back because I don't want it, especially by taking the whole panel off to find the cause and getting it welded.

Service manager called today and said they can't do anything unless BMW NA takes it back..

but he said it still needs to be welded weather I take it or not, and I told me do what you wana do, cause either way I am not taking the car back at all...



So, at this point what should I do? what should I do if BMW NA does not buy it back/

should I hire lawyer if they won't take it?

I want your opinion.

I wouldn't worry about it too much. It won't be visible and I don't think it's worth going legal.
See if you can get some compensation for,your inconvenience

Agree with jpdp...lean on them for some 'comp', and as it's a lease that 'rented' car is going back in 24 or 36 months, and it will be the next guy's worry...if it is a concern.

The only concern is that they'll have to repaint the B-pillar, so no original paint there.
But, as mentioned, it's a rental.
You won't be the one to have to deal with it.

When your lease expires, post your VIN.
Your fellow bimmers will then be advised.

I agree with previous posts. Why worry if it's a lease ? You covered for the rest of your lease term.

Thus, it makes you hate your rental.
It does suck.

But they won't take it back, so try to have some kind of compensation, and maybe something in writing, in case you don't want to take your rental back there, or if you plan to exchange it for another brand...
Not having the original paint will lower the resale value.

Thanks guys,

YES it is lease, but I am paying more because of its quality or expected quality..

it is may be not mine, but who would want to drive lemon or any car that has welding issue.

I just did some research and looks like any welding issue on A,B or C pillow is considering as structural problem, which most cases manufactures should buy it back.

I am just bit frustrated that I did not get what I paid for
