MotorDavid could not be more right! If you play this wrong with AMEX you will have to eat the lights and the charge. So stick to your strongest two points... A - the lights were described as Plug and Play, you went to an Authorized BMW mechanic who stated that unwarranted modifications to your vehicle would be necessary for installation. B - The time between the vendors reciept of your lights and their return to you. Then ask for a credit and ask how you should proceed.
No Editorial, No Rant, No Emotion... keep your cool and move on with your life. Also make sure you have a print out of the product description with the PnP line and your shipping receipts. Do not forward the email and other communications it's irrelevant and clouds the issue.
Good Luck
