1) Private industry ala Pitney Bowes, install, control and regulate, red light camera's. Which means, private industry not the state, not local law enforcement, are empowered to decide if you broke the law or not. - Since they have a fiducary incentive to determine that you did break the law, especially if the infraction is not black or white, but grey, it is unconstitutional.. It's like having a JURY that gets paid a bonus, if they convict you... 2) They do not improve safety 3) They are installed in areas that are most thought to increase revenue. 4) Studies show over and over that the decrease of "right hand, red light crashes" - decreases approximately the same amount that "rear end - red light crashes" increase.. "One issue is the potential conflict of interest when private contractors are paid a commission based on the number of tickets they are able to issue. Pictures from the San Diego red light camera systems were ruled inadmissible as court evidence in September 2001 (Judge's ruling). The judge said that the "total lack of oversight" and "method of compensation" made evidence from the cameras "so untrustworthy and unreliable that it should not be admitted"." "Another common issue is a challenge to the accuracy of the cameras. Cameras which give false positive results can cause legal issues. For example, a speed camera which reports the wrong speed may result in an attempted prosecution of a driver who was not speeding. In particular the cameras have often been accused of photographing the wrong car." B p.s. - I'm not saying that people should run red lights.. I am saying that RED LIGHT CAMERAS are not the way to solve the problem..

p.s.s. - I'm from New York, born and raised.. You have never seen a person as livid as a New Yorker, who gets a $130 ticket for J-Walking on an empty Los Angeles street.
Yes, that's right.. J WALKING folks.... If I can cross a street in Manhattan without worry, then why not in LA?? B

Did I ever say they were justified as a way of enforcement?? NOPE.
Point is, you break the law...you get caught....don't cry. People that run red lights should get a .44 in the head. Risking lives for the sake of it. Quote:

I believe he's thanking you for the grandmotherly advice/admonishment..... ( i agree with you QS, i've got 3 family members in law enforcement... the "the rules apply to everyone but me and i'll just lie and they'll believe me because i'm smarter than them" defense stories always make for good stories at family gatherings)

If you intend to go to court, you need to take some pictures of what the situation looks like, from your driver's seat, at that same time of day. traffic control devices can't be hidden, obscured, or placed in a manner so that you can't see them. there are rules that govern placement of these objects. My wife had a similar situation. I did all of the above, made a big presentation board, etc. I was fighting it because I couldn't believe what she did was wrong. At the last minute, I actually read the law, and found that what she did was not wrong! At the hearing/trial, the cop totally changed his story about what had happened. I actually think it was not out of malice, but I think he didn't remember - it had been 2 months since the ticket, and I can barely remember some obscure work item from 2 months ago. In this case, though, I was shocked, because it was so far from the truth. In the end, the judge ruled that her maneuver was not, in fact, against the law (at least against the section of the law she was cited for - I did not research the entire code to see if she was mis-cited). So, prepare your case, and read the law. Then decide if you have a case, and if it's really worth it. |

Sweet! I just got a check back for $158!!!
I can't recommend TicketAssassin.com enough for you CA drivers. I requested a trial by written declaration. Basically I just typed up a document that said "I plead not guilty". The cop that wrote that chickensh!t ticket never responded so it was automatically dismissed. http://www.ticketassassin.com My beef was basically on principle. This particular street is notorious for soccer mom types that pull u-turns and other bone headed maneuvers all times of the day, yet I've never seen anyone else get pulled over. I've seen pedestrians almost get mown down and have avoided several accidents myself because off these. If I see cops regularly pulling people over I'd have no beef about this incident. I got nabbed on a Sunday afternoon when the street was deserted. I politely asked for a warning (On a side note, I've had good karma talking my way out of tickets in the past), but this particular cop felt justified in pulling me over and writing me up for Driving while Brown. Suck it, chickensh*t cop. Suck it long and suck it hard.
