this is pretty common on 04-06 x5 4.4i, worn intermedate levers or siezed or sloppy intake manifold.

Never did find out what was wrong because they can't duplicate the problem. It doesn't seem to do it as much in the warmer months but I am getting close to being out of factory warranty and would love to figure this thing out.
