I would not take deliver of a damaged car that needs to be fixed by dealer either. It would be different if BMW repaired the car in VPC.

I say wait until they fix it, and then decide.

Replacing radiator and rear window & seal is not that complicated task to get it screwed. Remember, it was probably very junior guy out there who accidentally turned on power washer on high setting. They can probably replace the parts and you will not see a difference. After all, they are there to service BMW, technically they should be capable of taking the car apart and putting it back together...

Demand some (a lot) of free goodies.

BUT, I'd pissed as hell if it happened to me.... But the damage of this proportion would not be enough to have to wait for a new one. I am an impatient one when it comes to getting new cars

If you want a new car, do not accept it.
Otherwise if you can live with it, demand a cashback deal, free accessories or some other concession.

Depends on your personality. Most BMW owners tend towards OCD (myself included). We are very detail-oriented by nature and we take this driving/performance stuff very seriously, or we wouldn't be on this Forum.

If you feel like you can live with a new X5M that was substantially damaged and then repaired fully to your satisfaction, then it does not matter what others think. OTOH: f I was in your situation, I'd be obsessing for the next 2 years that they screwed somethng up on the repair, or I'd be hearing noises from the "fixed" window seal, or hallucinating about trace scratches from the washer damage (even if they were fully buffed out). So yeah, hands down I would NOT take delivery and tell them I want a new truck. To make the "fight" part easier, I would not even bother talking to the $tealer and take it up only with BMW Corporate. Let the parent company talk to the dealer and they'll give the dealer a stiff lecture about how to prep a new $93k vehicle. I'm sure that BMW Corporate will speed up your new allocation, and your next truck will be shinier than a 5 karat diamond.

Well, I am very detail oriented - especially with my car. In this case I believe that I am even more compulsive over it because of the fact that I ordered it, waited and anticipated the delivery - and it is an X5M!

Against my better judgement, I was told these problems would be easy to address (which has been wrong so far). As such, I already signed the purchase agreement and technically own the car now. If I decide that I am unhappy in some way with the repair when I go back to get it - what is the next option or path for me?

My position would normally be that I would not care if the vehicle had been fix and repaired as I image this is not an uncommon occurrence. (I think most new car buyer just don’t know when there were incidents that require correction - either on the line or at the dealer).

So, as long as it was put back together right and warranted, no big deal.



However, in your case, I would insist that the vehicle be repaired with:
  1. the correct window,
  2. the available window with it’s antenna functional and warranted for function,
  3. the promise that when the correct window becomes available, it will be installed,
  4. a discount for the incorrect window – which may lead to questions at resale time.

Unfortunately option B above poses some further issues:
  • If it is install functionally, and the correct window is replaced at a later time (because it gets smashed or replaced for any other reason), will the place that puts in the new glass know how to make the antenna functional?
  • If the glass has to be replaced again in the future with a non-antenna version who will be responsible for making the vehicle work with the normal antenna?
As for the radiator and BMW refusing to warranty it, I am assuming that means that BMW will not pay for the repair cost? The dealer having to swallow this is no issue, but what will happen to the vehicle if in the future there is another problem with the radiator? Will you be SOL? Is BMW washing it’s hands of the radiator altogether or just for this specific repair.

I imagine they are just not interested in paying for the repairs, but I would check to be sure of (and get it in writing) who is responsible for what repairs in the future to the replaced parts.

Signing the purchase agreement is fine. You will take an X5M but just not this one that has damage. You paid good money and don't want to live with a sub repair job depending on what they do. If you haven't taken delivery then I don't think you own it yet.
