Well for reliability and maintence cost I would pick the toureg. But for pleasure of owning and driving I would pick the ultimate driving machine, the BMW. Mercedes for me would come last since it doesn't really look "manly".

I was told that the 02+ ML's were the ones to go with when compared to the prior years as they had the least amount of problems.

Weasel will become famous soon enough
One of the techs from the BMW dealer moved next door to VW, said the V10 deisel toureg is a beast! I haven't any personal experience with one, but he said he liked it as much as the X5s.

X5... (of course!)

No, really - I recently got my X5. Toureg - I read too many not great reviews. Between an '02 ML and a '04 Bimmer, I'll take the '04 if it has lower miles. I tend to keep my cars for about 5 years. Even for the bimmer, I'll hope to keep my mileage under 100k over my ownership , because past that, the maintenance can start to go up.

If I couldn't get something low miles in my price range, I go Acura, Toyota, Lexus...really.

Just got rid of our '04 Touareg. Brilliant car. However, the six month repair and maintenance forecast covered half the difference in trading for the X5.

Reliability wise, the benz (I mean Daiymler) is the worst on all levels... X5 is probably in the middle, but VW is probably the most reliable but not far in front of the X, and if you're talking new E70 I'd say X5 all the way..but you're talking 04 E53..

I love my 2008 Touareg V6, it's been a spectacular car. Never had an issue, no rattles etc. My 2005 X5 on the other hand had nothing but issue, my 2004? No issues. Go figure! I wouldn't recommend the 2004 Touareg, it's the year it came out and was plagued with problems. They didn't get good until 2006. Their issues are not only technical but also extremely expensive. They also tend to have a higher resale value than the 2004 X5 for whatever reason. I would lean towards the Minivan, I mean ML as the 2002 was decently reliable.

E61Silver is an unknown quantity at this point
Get a 05 or 06 X5 and you will have good reliability and good driveabilty.

If you just want reliability get the MDX

oh and if you lean toward the ML, make sure it doesn't have the panoramic roof as an option. i don't think that MB ever got that right as i have only heard bad things about it.
