not really an option as I was upside down on the loan. I only took the loan because it was with Chase and I intended to refinance next year. Now I owe more on the car than insurance is going to pay. So it's either tear it down for parts and pay off the loan or fix it. it's not as bad as it looks either. All parts that are missing I took off the car myself. With the new front clip as you can see I get all the trim and the suspension.

You didn't have GAP insurance? You can it get through the loan as a one time fee or pay for it through your car insurance. I can't imagine the disparity between the loan value and payoff would be too great - can you just pay off the difference to your lender? I would never ever want to drive an X or any car that's been through that sorta repair. I seriously doubt you will come out on top or even break even on this deal. Will your lender even allow you to buy back the vehicle from the insurance company as a salvage titled vehicle?

the lender doesn't know about the crash. I'm still making the payments. Also one thing I left out that leans me toward fixing it is the driver was excluded. So insurance won't cover anyway. it's fine from the firewall back. I'm getting a whole new front clip. The only issue is pulling and reinstalling the engine. I have an excellent frame shop.

Isn't it illegal not to tell the lender about this crash?
Most documents you sign state that you must see
to it that their vehicle stays in good repair and
that any issues that changes that requires your
notifying them.

Also, if you are going to receive insurance for a totaled car, why not go to a dealership and buy a comparable X. Chances are you can buy the same exact version for what you are likely to receive from the insurance company, if not better since the SUV market has really been in a slide as of late..

Can't you roll the over payments into a new loan?

I think it means that the person driving at impact was excluded from the insurance policy, for whatever reason (DUI, not given permission, illegal a la cpatzer's fun, etc...) and the car was essentially uninsured.
