why no loaner car? that sounds strange.. sounds like they are jerking you around.. i would litigate.

I'd talk to the shop foreman and suggest him to either help the tech with the car or give the repair ticket to a tech thats better with electrical problems. And maybe a PuMA case (BMW email based technical support, engineers on the other end) would be in order.

They swears that BMW refused to pay for the first time (first eight days) because CPO doesn't cover bumper to bumper and determined that it is audio problem. Also stated that they had an entire service department meeting this issue was addressed. He also addressed that X5s have several boards and problem to different boards as they try to isolate the problem.

At least they are not charging me hourly as far as I know. I am paying 30 $/day for the Nissan Frontier since Fri. because they won't pick up the tap any longer.

How complicated can this be for those supposedly experts farting around over 15 days just to identify the issues?
I am getting the impression there's some smoke screen thing is going on but I will give them a few more days.

Toyota 4 Runner never looked so good after reading consumer reviews.

Some electrical demons have to kick your ass for a while. I am one of the better techs for electrical problems at my dealer, due in part to having my ass KICKED by some problem cars! I had a 6 series kick my ass for almost a month straight, with tons of outside help. Some problems are hard to find, but once they find what the cause is it should be fine.

Not trying to validate the dealer's excuse, but wasn't the initial iteration of DSP in the E53 fiber optic?

Have you considered trying a more competent dealer? I've done that in the past with good success.

Why would you buy a car that you had already leased and had so many issue with?? DUH!! NOw you're complaining? Sorry I don't get it. YOu should have left that problem with the dealer when your lease was up and got something else.
As far as your "lega issue" goes. In the legal worrls, there issomething called discovery. This is when on or both sides of the legal table gather all of the facts concerning the pending case and determine if 1. they even have a substantial amout of data to warrant a claim or counter claim, and 2. if the outcome of the case is going to warrant the financial burden presented byt litigation.

I dont know exactly what your long term goals are, whether you are after payment for the isuues, or a new car or what but on the surface it looks like a win win for the dealer, your lawyer and BMWNA.

I'm guessing you should cut your losses and get your car to someone that knows how to fix it. You are wasting your time with that dealer and will get nothing in return in terms of litigation I would pretty much bet on that.
