I feel like I got Screwed...!!!

A week ago I placed my order for an X5 and paid a deposit to the dealer. The dealer didn't have a car with my exact specs in stock, so it was a custom order. The car should go into the build phase either this week or next.

Yesterday, BMW came out with the $2500 rebate for the X5, but it's only for cars in Inventory. Had this been in place last week, I would have, without a doubt, picked out a better equipped car from the dealers inventory and went with that.

I assume there is now nothing I can do? I'm screwed?

Any advice would be interested.

Theres no penalty for canceling. Just go with a truck in inventory. End of story. You're never fully committed until you take delivery.

The dealer cant be that dumb. Ofcourse they will transfer his deposit to the new truck. They DO want the sale.

Maybe if he stays with the same dealer. It was my understanding when I ordered my car, it was a non refundable deposit. It was the same at another dealer I was working with.

I guess, you could always dispute the deposit with your credit card company.

The deposit was $2500 bucks.

I'd be THRILLED to get the exact I ordered but with the additional $2500 rolled in. I would also accept a better equipped truck off the lot. I'm not looking to screw the dealer...i'm still buying a truck from him either way. I just want the best deal to myself.

Whats difference does it make if the truck I ordered went into inventory and I took a different one out?

It depends on your State... many states have auto laws that are enormously in favor of the customer when it comes to deposits, e.g., Wisconsin.

Talk to the dealer, he should be able to work this out with the appropriate paperwork, e.g., cancel the order, let the vehicle arrive and go into the dealer inventory, and then buy it out of the dealer inventory.
