I only paid $500, and on a credit card. I am not concerned about the interest, more worried about PCD delivery slipping and the air fare...

I did search on 2010 BMW EPA trouble and got this coursey of E89.zpost:
Not just our X5's having trouble... Sorry to have my first post on this forum deal with such a negative matter, but it needs doing. I'm truly beginning to wonder when any of us awaiting delivery of our 2010 Z4 s35i's will ever receive them. Ship after ship is unloading them and all are being held in various BMW VPC's around the country because of literally a stupid clerical error made by someone at the California Air Resources Board (CARB). The needed certification from CARB should have been included in their September 24, 2009 Executive Order which was before the first 2010 Z4 s35i was offloaded in the USA. Those of us with the earliest orders should have had our deliveries well before now and should be enjoying our new cars. Those of you expecting deliveries soon shouldn't be holding your breath in anticipation. Until CARB gets off its collective, unconcerned rear end these vehicles will continue to accumulate and to be held in BMW VPC's. Don't like the situation? Regardless of whether you're directly impacted or not, read the email below that I sent on October 9, 2009 and consider whether you would like to let CARB know what you think about this matter. The email I sent was to Duc Nguyen, Manager of the On-Road Light-Duty Certification Section, which is the organizational entity within the California Air Resources Board where the error was made that has resulted in this problem. So far there’s been no response. Here’s the text of that correspondence: __________________________________________________ ___________ Dear Mr. Nguyen, I would like to know the exact status of the final California Air Resources Board Certification for the 2010 BMW Z4 s35i. On October 5, 2009 I spoke with Mr. Joseph Salmingo in your department and learned that this model was accidentally omitted from the Executive Order in which it should have been included A-008-0257-1 http://www.arb.ca.gov/msprog/onroad/...2d5-3d0_u2.pdf that was executed on September 24, 2009. He indicated he corrected the error with a revised order that was submitted the week before October 5 and he felt certain it would receive executed Certification no later than October 9, 2009. I sincerely hope you and your staff understand and have regret for the significant impact this error has had on BMW and its customers who are awaiting delivery of their 2010 Z4 s35i's and cannot receive them until this problem is rectified. In addition to this consideration there is a strong detrimental economic impact because loans aren't being made, transporters aren't making deliveries, dealers' staffs have not been able to do the preparatory work in which they normally would have been involved, salesmen have not been paid, taxes have not been collected and there are other material consequences of this nature. My car has been sitting in the Greer, SC BMW facility since September 26, 2009 pending delivery because of this problem and I want it immediately solved! Looking forward to your timely response. Sincerely, __________________________________________________ _________ This is the organization chart showing where Mr. Nguyen and his section are situated: http://www.arb.ca.gov/html/org/orgmsod.htm Annette Hebert, Division Chief for the Mobile Source Operations Division, is the lady who signs (executes) the Executive Order which will provide the needed certification. Perhaps some of you who are displeased with the handling of this situation also might like to call or send an email to any or all of the following parties: Duc Nguyen (626) 575-6844 [email protected] Annette Hebert (626) 450-6150 [email protected] And, no doubt, Virgil Welch, Assistant to the Chairman of the Air Resources Board, (916) 323-8511 [email protected] would welcome your thoughts: http://www.arb.ca.gov/html/org/offchair.htm Sincerely disgusted with bureaucracy and wanting my Z4 s35i, Ed |

but that is a California state issue. How would it impact deliveries to the other 49 states?

I am not certain but CARB and EPA tend to come up together and perhaps because CA is such a big market that manufacturors won't release a product without CARB and EPA certification. |
