Only $500 but not sure that this isn't costing the dealers in lost revenue for expected sales... These cars are part of their allocations that they were expecting to have and sell this month (off the lot or ordered).

there are a bunch of states that have adopted the CARB standards.......even though they may be the same tailpipe emissions that the EPA has, without the EO from CARB, they cannot legally be sold and titled in those states. Most of the Northeast states, exxcept NH, and a part of this group. I think there are over a dozen states that have adopted this language.

That's correct, but at least as far as we can see, they haven't been delivered ANYWHERE yet, isn't that right? So begs the question will they deliver in the states that aren't a part of this group?

Since they are keeping me planted for my 11/2 PCD date and since we've already booked (expensive) flights and scheduled time away from work I really hope they wouldn't spring a change on us last minute. Monday will be two weeks from the date.

That sounds so urban legend... or, like a typical forum post (no offense to XXX555)

There was still plenty of 2009 inventory in my area a month ago, assuming it's still there I'm going with BMW is holding up 2010's and allowing us to all think it's the EPA.

I have to say I agree with you. 2009 inventory or not, they have SOLD 2010's without any payment. Makes no sense from a business standpoint to delay the collection of that sold money just to try to squeeze a little more profit out of a 2009... Also, I haven't been able to find a 35d (2009 or otherwise) in dealer inventories around here.

Even if we find out the date of the EPA and CARB certs we will probably never know if that was the intended date or an actual delay.

This makes a lot of business sense, once the 2010's hit the lot, the 2009's are impossible to off load without substantial discounts that the dealer will have to absorb. These are desperate times for auto manufacturers, I wouldn't put anything past them. As for not finding any 35d's, there were never many and once the eco credit hit in August they were sold.

Of course we will. You actually think BMW would screw around with the EPA and CARB, delaying approval, just to have an excuse for not shipping?

BMW would not purposely delay EPA certification to avoid shipping new vehicles. Remember, they have not publicly announced EPA delay as the reason for the delay. If they wanted to delay it, they could have just idled the plant for any number of reasons.
