I don't know yet. I do know, from the police report, that he had insurance. If he doesn't have enough, I have uninsured/underinsured.

Glad you guys are OK.

If the other driver is at fault you should definitely push HIS insurance company to total your vehicle. I've been unfortunate enough to have been through a similar situation with my wife being T-boned while stationary waiting at a stop sign in our less than 1 month old Lexus. It really opened my eyes to how much of a PITA insurance claims can be.

I would also inform them that you or BMW depending on if this vehicle was purchased or leased will be seeking the loss of value of the vehicle on top of whatever the repair costs are. Usually that is enough to get them to total it. Remember it's the insurance companies job to get out of this as cheaply as possible. It's rare that their first offer is actually fair in my experience.

thanks. I did purchase it. And have clearly discussed with adjuster, that in my opinion the vehicle is a total, and I want a new vehicle. As I mentioned, yesterday, the BMW collision center was at $47K and climbing. Very close to a total. My inclination says it will get there. That is my goal.

I agree, it should be expensive enough to repair that it will be totaled. It's pretty substantial damage to the unibody and I'm sure the driveline received a substantial amount of damage as well.

But do you have uninsured/underinsured physical damage (some states do not allow this)? If not, you will have to file a claim under your own physical damage coverage. Un/Under is normally coverage for their deficiencies in providing liability coverage.

Good question. I don't know if I do or not. Guess it will depend on his policy which is being pursued, in conjunction with what my final value is determined to be.
