I've been doing this for over 30 years - You always ask for your old parts back, even if you don't actually take them with you at the end of the job. It keeps them honest.

The old transmission - he bought a new (used) one so the core is his. Or like you said, mark your part & see if it's been changed. I watched a news report a while back about just that. They marked their good oem parts and set up hidden cameras on the vehicles. Went to shops with specific complaints - was sold a "new" part (cleaned & painted) but was the original part.
