Honestly, I think I recall this going both ways. If the dealer can get their hands on a MkIII then that's likely what they will use (a like for like). If not, you'll get the benefit of getting upgraded to the MkIV for free.

For your sake, I'm keeping my fingers crossed that the dealer is unable to locate a MkIII.

Guess I'll just take it to the other 3 BMW dealers in town as well. They didn't replace the CD drive at all. They just flashed the software - which I could have done. What I don't want is for the drive to go bad now that I only have 200 miles left on my factory warranty and CPO doesn't cover it.

Keep your records on this. If it fails in a reasonably short time frame after the warranty expires then BMW should still cover it under "good will"

Odd...

The dealer said they "flashed" a new version of the software but it still says 3-1/40 ( I think). I know they are definitely newer versions for the Mk3. Perhaps they flashed the Radio's software? When I get in to the X, sometimes the BMW logo appears immediately and sometimes it's not til I have driven away. Sometimes teh "Please Wait" screen somes on for a few seconds and sometimes not. Is this just the OS booting from a "cold" state or what's the deal? Teh Navtech CD is one the dealer snagged from another vehicle so maybe they are out of sync? Also, I notice that when I have the map in "direction of tavel" mode, it takes what seems like way too long to actually chage the map direction once I have turned on another road and sometimes it looks like I am playing "Asteroids" as the triangle is just spinning of facing the wrong way. Ultimately it's not a big deal, I'm sure I am being WAY too picky - provided this is "operating as designed".

The latest OS for the MkIII is 3-1/63, and any disk higher than V22 will take you to that level.

3-1/40 is V18, which is ANCIENT!!! It's the very first splitscreen release and there were plenty of bugs in it. If it were me, I would take a copy of this Service Bulletin back to the dealer and have them get your OS updates to the latest supported level - http://www.xoutpost.com/pdf/v26.pdf

From the descriptions, it still sounds like your nav drive is starting to get a bit flakey. As mentioned before, keep all of your records so that if it fails after your warranty has expired then you can show the dealer that you had identified this problem to them prior to that.

I just looked again at the Nav CD that the dealer popped in until they get my new one ine and its like 2000.1 or something like that. Could that be causing some oddities?

You seem to be confusing the nav OS CD with the nav map CD. Two different animals.

The OS CD is a one-time use disk that is used to update the operating system firmware on the navigation drive. Think of it as the difference between Windows 98 vs. Windows ME vs. Windows XP. All of these will run your PC, but XP each has additional enhancements that make people want the latest and greatest.

The navigation map is the disk that is kept in the nav drive during normal operations and it contains the database of maps and routes that provide the guidance for the vehicle. If you have version 2000.1 then you have an ANCIENT map disk. It can cause "oddities" in that the map database you have is over 5 years old and contains lots of outdated and/or is missing information that is now found on newer disks. The latest is version 2005.2 and there have been many updates in between. You can get new map disks at http://navteq.com or on eBay.
