Bingo! You beat me to it. I don't think the smoking law is any different than the child seat law. It's not about individual rights or freedoms. It's about society's moral obligation to protect children from harm. I hope it's no longer necessary to debate whether second hand smoke is harmful to children. Should society allow parents to deliberately harm their children? If we let them smoke in the car with their children then we might as well let them put their kids on their laps while they drive.

I have to say I do see the other side of the argument.

NYC requires child guards on the windows.
My feeling is that if look after you children they are not need however NYC requires them. My daughter grew up in a 4th floor apartment without guards and never even came close to falling out the window.

This may go against the American way, but it's just another step towards phasing out smoking altogether. It's completely inevitable.

Perhaps the arguement boils down to doing what's right. Yeah we can gripe about this law and that law but the real deal is that some folks just wont do right. Then when we see that people are being dumb and stupid and refuse to do what's right then you hear the old saying "their outta be a law" Then when someone proposes a law we clearly know is right then we get people who want to rant about their freedom. Freedom to keep on doing what is clearly wrong.

I guess people want to do what's right as long as no one has the right to tell them what's right and when and how to do it.

Sounds like a bad case of pride to me............

In short... everyone knows it's wrong to smoke in a car with children just like they know it's wrong to FART in a car with the windows rolled up. Stop making excuses about the government trying to restrict your rights. If you did what was right to begin with it wouldn't be an issue......

Actually there is a law that covers all of this.

Do unto others as you would have them do unto you.
It's the natural law that when practiced eliminates
the need for legislative law.

I went to elementry school with a young girl named Hannah, who in 5th grade, lost her younger brother because he was jumping up and down on a bed in an apt. building and he bounced and fell out the window.
- I also remember her father tried to keep the child alive performing CPR for 45 minutes till the paramedics arrived.

I still remember the day our teacher came into the class to tell us what happened, and it must have been 25 years ago.

Then I also remember it also happening to Eric Clapton's child.. Not saying it happens everyday, but it happens enough..

Here's another question,

Should children be allowed to sit in convertible cars with the top down?

Isn't there also a VERY strong risk of skin cancer from direct sunlight, etc.?

And, what about smoking a cigarette in a convertible with the top down, with a minor in the car.. Is that OK?

Again, I have very mixed opinions on the matter. I think it's good intentions, but the path to hell is paved with good intentions..
