To conclude after spending what seems to hours/days ripping it all apart to see if anything was broken I think the main unit is at fault. Without getting another one to test I can't bee 100% sure...

So on your x5 does it always just says activate phone and not pairing. And also do you have the arm rest button as well which you dont need to press.

Hi checked the VIN details and it says BMW assist is present it looks like a TCU unit I am not sure if I need to press the button in the console arm rest while turning the ignition

I've attached two images hopefully they are clear, I bought it from a private dealer who also swapped out the front dash control with working x5 to make sure it wasn't the switches same issue.
