Bnagy, this is pretty ridiculous, some junkyard in California rebuilding 4.8is engines? I would think they would fly in a BMW master tech certified by Alpina or something to rebuild it in a specialty BMW shop or something, if they wanted to truly "make it right".
About your car sitting, as long as they are not charging you for the loaner, I wouldn't fight them on depreciation cost as they are giving you a free set of wheels in the meantime (not like they made you take out a rental car on your insurance policy or anything, which would suck ass since rental cars suck) I would make my phone call to BMW NA and get them involved, this dealership is playing games and the fact they'd ask you to cough up the difference that their insurance company wouldn't pay is ridiculous. It's not like they are some Chuck with his Truck used car lot, they are a FRIGGIN BMW DEALERSHIP! You're telling me that they couldn't eat the difference? They sell 3 cars and they made that up already! BMW NA posted on here earlier I hope they sent you contact info! |

I've watched this thread since it's beginning and my heart goes out to Bnagy. However, we all know that the squeaky wheel gets the grease. The longer this languishes with inaction the worse it will turn out. IMHO, both the dealership and BMWNA need to hear from you on a daily basis, if not twice daily or more. When they dodge your calls head to the local TV station and their reporter who takes these kind of stories. Then head to the corporate entity who owns the dealership. They carry insurance to cover these types of issues. All corporations do. The more noise you make the quicker and better the resolution will be. Good luck, know that we're all rooting for you.

Rule of thumb--when you have a problem that you (the customer) know you have been logical, considerate and patiently waiting for a resolution and still don't have a reasonable response--move higher in the chain of command--get to someone you have not spoken to before. You have been all the above, lay out a timeline of what has happened and who you talked to each time and go higher. Hopefully, you appeal to them in written form. If you can get that timeline to someone that shouldn't have to deal with it they will (S**t rolls downhill) jump someones behind and usually quickly get it resolved to at least your satisfaction. If not to your satisfaction you will have their final answer to accept or call your lawyer. If you feel you have not exhausted your case with BMW NA I would still do the timeline and copy someone up the ladder.

So do they have your X5 inside or is it sitting outside all this time? I'd insist that they park it inside or detail it before you get it back.
I agree with continued escalation. Better Business Bureau. State of Washington licenses dealers, right. Nice complaint letter to them is in order too. Also, BMW NA needs to consistently hear from you. Have you sent a letter to the editor of the Roundel yet? Squeaky wheel time. |
Update 6/10/2013: HERE WE GO AGAIN!!! Today I receive a phone call from the service manager (who is pissed as well I must add) that informs me that the company down in California (Bavarian auto recycling) who WAS going to rebuild my motor with a 5 year warranty, wouldn't have my engine back for 60-90 days. This is after the insurance adjuster was told that their turn-around was 1-2 weeks. So now that option has gone out the window!
So what does BMW have for a plan B? How about a used motor with 46XXX miles on it WITHOUT a warranty. So lets to a fast speed replay on all the events that have taken place since March! I took my car into BMW for an oil change, they Fu** up my engine, they try to total my vehicle, that backfires and they try to get a used motor, the company they were getting the motor from pulled a bait and switch, they send a foreign motor from god knows where to BMW with out markings, vin etc., we deny the motor, they (the insurance company) takes a month to figure out what is going to happen, they come to a decision to rebuild the motor with option A (BMW rebuilds it and I pay $1750) or B (Bavarian auto recycling rebuilds it with a 5 year warranty), we choose option B (obviously), that falls through because it would take 3 months to get my engine back to BMW, Then BMW tries to step backwards and offer us another used motor with 46xxx miles and with out a warranty, we would not accept anything less than a rebuilt motor (total engine overhaul), they all of a sudden find a brand new engine in some where in the country that is brand new with 0 miles and if they cannot get their hands on that, then they are going to order one straight out of Germany (this I their promise) we will see if they deliver. |
