After the beatings and six months' hard labor? I got shipped off to a university in Rhode Island and was forced to study Wordsworth and Chaucer. And I got to drive a 17-year old Volvo with bad main seals, a master clutch cylinder that needed a daily fill-up, and SU carburetors that leaked gas like an orchid mister. But I had g/f who was from Mallorca. And I didn't have to take any math courses. So it worked out pretty damn well.

My recomendations:
1. Get legal counsel. 2. See if they are willing to drop the points from getting to your license. 3. Get a V1 ASAP Good luck...

There are some possibilities here! You say he paced you for only 0.5 of a mile from where he was parked at a stop finishing off another ticket to where he pulled you over, Yes? If that is true find out how far police have to pace you in your area to get a "true speed" reading, if he had to exceed the speed limit to catch up with you and only checked your speed as he put on his lights at your bumper you could do road measurements and prove that the cop was only using his speedo to guage your speed and inaccuratly checked your speed as he was slowing down. The fact he wrote you up for 62 in a 40 zone seems to confirm my theory. I make the presumption no radar was involved? I have used this defence in the past and it has worked but you have to take pictures of the road from where he was at to where he pulled you over and get him in court to confirm this in front of the judge. Then some math comes in to prove how fast he had to accelerate to catch up with you. Some county road maps will help your case as they show recognized distances and the layout of the curve. Can't help you on the 55 in a 40 zone unless you can prove that there was very little traffic and you were observing a safe speed at the national speed limit (worked for me before when I got pulled over at 2AM in a 45 zone) Hope that helps, but if your unsure I would really contact a lawyer as suggested earlier.

Do American mothers think it is responsible driving for their 17 y.o. sons to do 101 mph racing other drivers on public roads with the possibility of not only hurting themselves but innocent parties? Obviously yours doesn't as she went into bat for you so that you 'got out of jail' and probably didn't learn anything from it (unless you count the extra garden chores, the downgrading in vehicle and educational 'torture'). My mum would have given me a flogging and let me wear the consequences! So from the other posts, is the answer to breaking the law to get your parents to pay for some lawyer to get you out of the sh*t that you got YOURSELF into? yeah riiiiiiight! |

Forgive me, but don't the Police have to prove that you were careless driving, speeding etc etc??
In England, this could not be upheld in court without video evidence or independant witnesses etc etc. 'Paced' - you mean he followed you and timed you over a distance - hence was able to average your speed (speed=distance/time). Over what distance were you paced? Where was the starter/end marking, was it daylight? Over a short distance, what error factor is there? etc etc etc Get yourself a lawer and fight.

Are the tickets time and date stamped? If he was writing a ticket when you passed him, perhaps you could demonstrate that he couldn't have had adequate opportunity to make an informed judgement let alone "pace" you.

RobC, different rules here in the States mate. If you present a viable case with specific evidence the judges here will usually go your way unless the officer has irrefutable evidence to your point pictures radar etc. At least thats my experience along with a couple of friends who have used my advice. I always pay my tickets when I'm in the wrong but when I know I'm right I have fought every time and won, by the way this was in SoCal (Los Angeles) not the best cops or courts in the land but not the worst either. The judges see so many folks who come in hoping the cop won't turn up and either leave if their officer is present or offer a stupid argument for innocence with no evidence. When you walk in loaded for bear they suddenly have a lot of respect for you especially when the officer is used to verify your arguments because you did your homework. This is the land of very few speed cameras.
