Oh, have the passenger seat and rear seat headrests all the way down so the SA and tech's necks get snapped really good. That'll teach 'em to doubt you! Alternately, go very slowly up a steep incline and then get on the gas. The key is to have the trans shift from 2nd to 1st from a slow roll. FWIW, BMW NA replaced my trans after keeping the X overnight w/it hooked up to BMW NA's computer (PUMA case was created for it). Good Luck!

Be polite but firm with the service advisor. If he is unwilling to work with you, ask for the service manager. Explain that you are not satisfied with the service and will be unable to offer any rating higher than a 1 for the BMW survey at this time. That should get their attention as their paychecks are heavily influenced by the BMW survey results. Explain that you would love to give them all 5's, but since they won't even try to address your problem, 1's it is. Promise to give them all 5's if they fix the problem (and then live up to your promise and no nasty comments as they see everything you say). At the very least, they should reprogram the trans with the latest software and see if that helps. If it doesn't (and it didn't in my case), bring it back and have them open a PUMA case for your vehicle. There is also the regional service manager who can help but their jobs appear to be mostly to deny anything (depends on the person...). Good luck.
