TRANS FAILSAFE PROGRAM. May this never occur again?
The mechanic cooled me down as a slipping problem between gear 3 and 4 is rare and the chance for a big gear size to be eaten up is not highly probable. He thing there is a 75% chance that this might never happened again. What do you think? is there anybody that faced this just once with no second occurrence? I am afraid to flush the tranny oil because there is a lot bargain about such a step

Don't worry until the problems comes back. Most likely the battery was drained down, and you just got the error before it got fully charged.
Could be anything. If it happens again, then worry.

Hope it is something negligible that happened. The scanner showed that error occurred when bat was at 13.7v so the voltage was adequate. May be a test drive in a steep hill may help to discover more. Thanks SlickGT1

Hmmm. Well if there is something, it will show up soon enough. Do yourself a favor and get the trans oil level checked. There is an exact procedure done with a gt1 to monitor temp. Search trans fluid drain and fill.

Let it go unless becomes regular. The code you got just means there was a speed mismatch. I dunno what your dude was talking about as far as gears go; slippage that gives a code like that involves the clutches in the trans as it "transitions" from one gear to the next. If your trans is going, you'll get real familiar with the situation pretty fast. Lots of quirks in the E53, including stuff like: "X happened to me, but only one time" type of quirks.

You might just need a trans fluid and filter change along with a reset of the adaptations on the trans. computer.

Have you EVER serviced ANYTHING in the transmission?!??!?!
Fluid needs to be changed. The BMW nonsense of "lifetime" is a myth. Over time, parts wear, fluid degrades...valves stick, and/or seals between hydraulic circuits leak... this lead to- initially- transient errors like you see, then ultimately failure. Service the trans- new fluid, filter. Go from there. The fact that it was a week after you bought it, somebody lied to you. IMO. Did you have the car inspected and read the DME for any fault history? $100 says 'no'

Did'nt happened till now for a second time. I have checked oil level and I found near a cup of tea of extra fluid inside (@ 41 degree c). I found this on the Internet too

i seriously doubt that there something mechanical or hidraulic is going on - chances are, something rather on the electronic side of the house... the gears are shifted based on the vehicle speed, and the engine speed (super simplified, there are whole bunch of other sensors involved). If a speed sensor in the rear right is slipping the transmission may get "confused" and select incorrect gear, or the truck will go into "limp mode" just for sake of avoiding further mismatch between the road speed and engine speed...
I had this happen on me in E34 when I span on the highway 4 times before coming to a stop - i had the car for a week, was going to NYC for a party and thought that I broke the new car... tuned the engine off, back on, never seen that message in the next 10 years... saw that message in the E53 (4.6iS) when the ABS module went bad, saw the same message when the speed sensor lost its conncetivity - the failsafe mode is the 3rd gear, that is all... if there was mechanical issue, you would probably know by now, with all the wierd noises, vibrations, and other mechanical things that would have manifested itself... I am not 100% ruling out the fluid and gears - just pointing out that these things may have so many other reasons for failsafe mode...
