I went to the dealer to see my car since they parked it outside. I was told that they put the heads back on so I wanted to pop the hood and get some pictures. This is what I found (other than no cylinder heads). It's been 50km/h winds and snowing, with much more snow coming still.

I had occasion to talk to these people this summer in Calgary in regards to their ability to recode my ABS Module if I had to go for a rebuilt or new- and yes they have the software to check and recode for my 2001 X5. The front end girl had more knowledge than the dunderheads at the dealer. Might be worth a phone call to see if they might be able to help you out. German Car Specialist

I usually don't say this but it's time to get lawyer involved. It's unthinkable for a good shop or good diy to not cover the exposed area like that immediately after the removal.
You should really have the insurance pay for the new engine from Morristown BMW if that price is real which is unreal deal. And then have somebody else install it and get away from those jokers.

Me best guess is they figured since the heads are getting replaced they didn't need to cover it up. I would feel quite foolish to send a lawyer after them to find the brackets around the eccentric shaft did warp but the heads didn't.

I think the recommendation to get a lawyer involved was due to the gross mishandling of this entire issue. First they recommended a $28K engine replacement. It doesn't appear they even performed any basic troubleshooting...i.e. the lack of compression / leak down test. After you brought this to their attention they then replaced the valve seal gaskets which, apparently, they didn't do properly resulting in damage where none existed before. Now they leave your vehicle outside exposed to the elements (seriously...there's snow on that engine, or is that frost?). I'm with bmw540san in that it might be time to get a lawyer involved. Give them an opportunity to fix it at their cost. If not start looking for a lawyer. I could do a better job than these guys (and that's saying a lot).

Talked to the service manager. He says the heads are warped. So I am getting the original heads when they pull them and will be checking that claim. About the snow he'll get it vacuumed. Said with oil on it there's no damage to be caused by some water. Right, except for the intake manifold. I'm going to call my warranty company and share this snow issue with them. I doubt they'll be as relaxed.
